Terms & Conditions – Returns Policy

Your Right to Cancel and Return (Consumer Contracts Regulations 2013)

  • If you purchase goods online, you have the legal right to cancel your order within 14 calendar days from the day after you receive the goods.
  • To exercise this right, you must notify us in writing (email or letter) within the 14-day period, we can be reached at [email protected].
  • You then have a further 14 days from the date you notify us to return the goods.

Returns After 14 Days

  • Any returns requested after the 14-day cancellation period are at our discretion.
  • Where we agree to accept returns outside the statutory period, we reserve the right to apply a restocking fee of up to 15% of the item value.
  • Please note that for returns accepted after 14 days, the original postage costs will not be refunded.
  • Returns after 30 days can not be accepted

Condition of Returned Goods

  • All returned items must be in an “as new”, re-saleable condition, including all original packaging, labels, and accessories.
  • Items that show signs of installation, use, modification, or damage will not be eligible for a refund.
  • We recommend taking care when unpacking and inspecting goods to ensure they remain in a re-saleable condition should you wish to return them.

Refunds

  • Refunds will be processed using the same payment method used for the original transaction.
  • Where applicable, deductions for restocking fees or any reduction in value due to handling beyond what is necessary will be made.

Return Costs

  • The cost of return postage is the responsibility of the customer, unless the item is faulty or not as described.
  • We recommend using a tracked and insured service, as we cannot accept responsibility for items lost or damaged in transit.

Faulty or Incorrect Items (Consumer Rights Act 2015)

  • If your item is faulty, not as described, or unfit for purpose, you have the right to a repair, replacement, or refund.
  • You must notify us within a reasonable timeframe and return the item to us for inspection.
  • In these cases, we will cover the reasonable cost of return postage.

Payment

We use payment by PayPal which accepts all leading credit cards including: Visa, Mastercard, Discover and American Express.

No goods will be dispatched until full payment has been cleared by the payment provider.

Pricing Errors

If we discover an error in the price of goods ordered or reserved, we will inform you as soon as possible (e.g. prior to the goods being despatched or prior to the collection of the goods). We will provide you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you choose to cancel and have already paid for the goods you will receive a full refund.

Minimum Invoice Value

There is no minimum invoice value for deliveries to U.K Mainland addresses, any deliveries outside the U.K Mainland will require a minimum invoice value of £10.

Back orders

Performance Airflow will chase any back orders with SPAL on the behalf of their customers. Performance Airflow will ship all orders as soon as they are complete.

Cancellation

Cancellation of an order must be made by email before the goods are dispatched.

Shipping Policy

Loss or damage of goods must be notified to us within 5 working days of receipt. Non-receipt of the entire consignment must be notified to us within 14 days of the invoice date or 7 days of expected delivery date stated at checkout for shipping option selected if it is the later date.

Performance Airflow will not accept liability if a claim on the carriers cannot be sustained after this period.

Parcels sent with Royal Mail are not classed as lost until 3 weeks after sending date, Customers whose parcels that have not arrived in this period should notify Performance Airflow via the contact tab on the website, any refund or replacement will not be accepted until after this period

Parcels sent without tracking, are done under the assumption that the buyer is aware. There are different shipping options available. Items dispatched without tracking may experience delays or loss during transport, Performance Airflow cannot be held responsible for this if a buyer chooses this shipping option. If a tracked shipping option is not listed please contact Performance Airflow via the contact tab on the website.

All Buyers are requested to provide a contact telephone number, that we can pass on to the delivery company/Agent to assist with delivery.

Custom Duties and other taxes

Customers outside the UK are liable for all import duties and local taxes. Performance Airflow is not required to charge customers any taxes or duties, any taxes or duties which are levied by the receiving country are the responsibility of the customer.

If these taxes and duties remain unpaid goods will be destroyed at point of entry by the carrier and Performance Airflow will be unable to offer any refund on your purchase.

Liability

We fully guarantee all items shown in all SPAL catalogues against faulty materials or workmanship.

If any fault due to bad workmanship or materials is proved and the details notified to the company within twelve months of purchase, the company will at its own cost and its own option repair or replace the faulty article but subject to this all express or implied warranties or conditions as to quality or fitness for any purpose of the goods are hereby expressly excluded. It is the responsibility of the installing engineer to check components before and during installation.We will not accept under any circumstances liability for consequential loss or loss of profits arising on any contract.

General

All contracts between Performance Airflow and its customers are in accordance with English Law and shall be governed by the above terms of trade, which replace and override all other terms of trade.
